Axly Traffic Terms of Service

These Terms govern your access to and use of Axly Traffic, including axly.ca, the member dashboard, traffic exchange platform, credit system, paid plans, downloadable desktop application, APIs, emails, support tools, and related services.
By creating an account, installing the desktop app, submitting a campaign, purchasing credits, subscribing to a plan, or using the Service, you agree to these Terms. If you do not agree, do not use Axly Traffic.
1. Service Description
Axly Traffic is a website traffic exchange, visitor discovery, and website feedback platform. Members may earn internal credits by viewing approved websites or completing feedback tasks. Members may spend credits or monthly allocations to receive visits to their own approved campaigns. Axly does not guarantee sales, leads, conversions, advertising revenue, search engine rankings, analytics accuracy, or any specific business result.
2. Advertising Network Warning
Axly Traffic is not intended to artificially inflate advertising impressions, advertising clicks, affiliate conversions, paid campaign metrics, search rankings, or third-party platform statistics. You are solely responsible for complying with the rules of Google AdSense, Google Ads, Meta, TikTok, YouTube, affiliate networks, analytics providers, hosting providers, payment processors, search engines, and all other third-party services.
You must not use Axly Traffic to encourage ad clicks, generate fake ad impressions, misrepresent traffic sources, bypass fraud systems, or violate any third-party platform policy. Axly is not responsible for account restrictions, invalid traffic deductions, demonetization, bans, payment reversals, search ranking changes, analytics discrepancies, or lost revenue.
3. Eligibility
You must be at least 18 years old, legally able to enter this agreement, provide accurate information, use a valid email address, and comply with applicable laws. You may not create multiple accounts to bypass limits, gain credits, manipulate referrals, or evade enforcement.
4. Accounts and Security
You are responsible for your account, login credentials, and all activity under your account. Axly may suspend, limit, or terminate accounts suspected of fraud, abuse, unauthorized access, duplicate registration, payment abuse, security risk, or violation of these Terms.
5. Website Campaigns
By submitting a campaign, you represent that you own or have permission to promote the website, the website is lawful, does not infringe third-party rights, does not contain malware or deceptive content, and complies with these Terms. Axly may approve, reject, pause, remove, reclassify, limit, or manually review any campaign at any time.
6. Prohibited Websites and Content
You may not submit websites containing malware, phishing, scams, fake login pages, illegal goods, hate, harassment, exploitation, copyright piracy, counterfeit goods, stolen data, hacking tools, forced ad clicks, browser-locking behavior, excessive popups, deceptive redirects, or any content Axly determines creates legal, security, reputational, operational, or user-safety risk. Adult, gambling, cannabis, financial, crypto, medical, political, or other regulated content may be restricted or require manual approval.
7. Credits
Axly uses internal credits, points, or visit allocations. Credits have no cash value, are not legal currency, are not transferable without permission, may expire, may be deducted for invalid activity, and may be adjusted for technical errors, abuse detection, or administrative correction. Axly may change earning rates, spending rates, visit costs, bonus credits, and expiration rules at any time.
8. Paid Plans and Monthly Allocations
Paid plans may include monthly credits, campaign slots, targeting options, visit allocations, priority features, analytics, feedback options, or other benefits. Any stated monthly visit amount is a maximum eligible plan benefit under normal operating conditions, not a guaranteed minimum unless expressly stated in a separate written agreement signed by Axly. Delivery depends on active user supply, targeting settings, campaign status, visit duration, daily limits, fraud prevention, website uptime, technical conditions, and network capacity.
9. Visit Quality and Analytics
Traffic exchange visitors may be incentivized, non-targeted, low-intent, or browsing primarily to earn credits. Third-party analytics may filter, ignore, classify, or adjust exchange traffic. Axly stats may differ from Google Analytics, server logs, ad platforms, affiliate systems, or other tools.
10. Desktop Application
Axly may offer a Windows desktop application. The app is licensed, not sold. You may use it only for lawful Axly activity. You may not modify, decompile, reverse engineer, tamper with, resell, redistribute, bypass timers, bypass heartbeats, evade version checks, use automation, run hidden/farmed sessions, or simulate user activity. The app may collect and transmit account ID, session ID, IP address, device information, operating system, app version, browser/runtime version, timestamps, visit status, campaign IDs, error logs, heartbeat signals, abuse signals, and security events. Axly may require updates, disable outdated versions, block suspicious devices, or force logout.
11. Feedback Tasks
Feedback must be honest and human-written. Random, fake, copied, abusive, automated, or meaningless feedback may result in rejected feedback, credit deductions, reduced quality scores, or suspension. Feedback may be shared with campaign owners and reviewed by administrators.
12. Payments and Billing
Paid plans and credits may be processed by third-party payment processors. Subscriptions renew until cancelled. Failed payments may result in account limitation or loss of benefits. Axly may change prices, plan features, credit values, or billing terms according to notices shown at the time of change.
13. Refunds
Refund eligibility is described in the Refund Policy. Refunds may be denied for renewals, substantial use, violations, abuse, chargebacks, payment disputes, custom deals, or non-refundable offers. Chargebacks may result in immediate suspension, loss of credits, and removal of campaigns.
14. Email and Communications
By creating an account, you agree to receive transactional emails about account, security, billing, support, campaigns, app updates, policy changes, and service operations. Marketing emails require opt-in where required and will include an unsubscribe method.
15. Privacy
Information collection and use are described in the Privacy Policy. By using Axly, you consent to the collection and use of account data, campaign data, app session data, technical logs, security events, communications, and payment-related records as needed to operate and protect the Service.
16. Intellectual Property
Axly Traffic, logos, software, interface designs, documentation, source code, and related materials are owned by Axly or its licensors. You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, clone, or create competing services based on Axly materials without written permission. You retain ownership of your website content but grant Axly a limited license to display, load, preview, categorize, review, scan, cache, and transmit campaign URLs as necessary to operate the Service.
17. Third-Party Websites
Axly displays or links to user-submitted websites. Axly is not responsible for third-party website content, privacy practices, tracking, products, downloads, advertising, errors, or downtime. You access third-party websites at your own risk.
18. Prohibited Technical Activity
You may not use bots, scripts, automation, macros, fake browsers, auto-surf tools, proxies, VPNs, virtual machines, emulators, remote farms, header manipulation, referrer manipulation, scraping, unauthorized API access, or any method intended to bypass limits, simulate users, or interfere with Axly systems.
19. Enforcement
Axly may investigate suspected violations and may warn users, reject campaigns, deduct credits, reverse rewards, remove visits, limit features, require verification, block devices/IPs/domains, suspend accounts, terminate accounts, refuse refunds, report unlawful activity, and preserve records for legal, security, or fraud-prevention purposes.
20. Availability and Changes
Axly may modify, update, suspend, limit, discontinue, or replace any part of the Service at any time. The Service may be unavailable due to maintenance, outages, attacks, bugs, hosting issues, legal requirements, or other causes. Axly is not liable for downtime, interruptions, data loss, traffic delays, failed visits, or undelivered allocations.
21. Disclaimer of Warranties
The Service is provided “as is” and “as available.” Axly disclaims all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.
22. Limitation of Liability
To the fullest extent permitted by law, Axly and its owners, contractors, employees, affiliates, agents, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or business damages, including loss of profits, revenue, goodwill, data, traffic, rankings, advertising accounts, payment accounts, or business opportunities. Axly’s total liability for any claim will not exceed the amount you paid to Axly during the six months before the claim, or $100 CAD if you paid nothing.
23. Indemnification
You agree to defend, indemnify, and hold harmless Axly and its owners, contractors, employees, affiliates, agents, suppliers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your campaigns, your violation of these Terms, your violation of law, your violation of third-party rights or platform policies, your fraud or abuse, or disputes involving your website or business.
24. Governing Law and Disputes
These Terms are governed by the laws of Canada and the applicable laws of the province or territory in which Axly Traffic’s operator is legally registered, without regard to conflict-of-law principles, unless consumer protection law requires otherwise. Before filing a claim, you agree to contact Axly and attempt to resolve the dispute informally for at least 30 days.
25. Changes
Axly may update these Terms at any time. Updated Terms will be posted with a revised date. Your continued use after changes become effective means you accept the updated Terms.
